Custodial rights do not refer to where a child will stay. This term refers to major decision making for a child. The parties can have joint legal custody and make decisions together, or one parent can have decision making authority or sole legal custody.

The major decisions involve schooling decisions, medical decisions, religious upbringing, whether a child can join the military before the age of 18, and whether or not a child can marry before the age of 18. It is important to note that the Court generally presumes that Joint Custody is in the best interest of minor children.

Placement

Where will the child reside? The Court is really interested in where the child or children will sleep at night. In Wisconsin, the parties can share placement of the children or one parent or the other can have primary placement. The Court presumes that both parents should have maximized time with the child or children.

Maintenance

In the state of Wisconsin Maintenance is the same thing as spousal support or alimony. Maintenance is generally handled in cases where the parties have a long-term marriage and there is disparity in the parties’ incomes, one party has health issues, or one party has limitations on their ability to work due to disability or other issues.
